The terms for using our website, our online estimates and paying invoices online, written for Colorado homeowners.
Agreeing to these terms
These Terms and Conditions (“Terms”) apply when you use www.newwestcolorado.com, request an estimate, or pay an invoice online. By using the site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the site.
Any construction work we perform is governed by the written proposal or agreement you sign with us. If that agreement and these Terms ever conflict, your signed agreement controls.
Who we are
New West Co LLC is a Colorado limited liability company based in Timnath, Colorado. Colorado licenses building contractors through local building departments rather than the state; we hold the local licenses our projects require and carry general liability insurance. Proof of insurance is available on request.
Online estimates and project ranges
Our online estimator gives planning ranges to help you budget. A range is not a bid, a quote, an offer or a contract. Your actual price is set in a written proposal after we see the site, because conditions such as access, framing, drainage, hidden damage, permit requirements and material prices affect the cost.
Proposals are valid for the period stated on them, usually 30 days, because material prices change.
Proposals, agreements and change orders
- Work begins after we both sign a written agreement that describes the scope, price, payment schedule and estimated timeline.
- Changes to the scope must be agreed in a written change order, including by email or electronic signature, before the changed work is done.
- Schedules are estimates. Weather, inspections, permit timing, material delays and site conditions can move dates, and we will keep you informed.
- You agree to give us reasonable access to the work area, utilities and a place to stage materials, and to tell us about known hazards, property lines, easements and HOA rules.
Deposits, invoices and online payments
- A deposit, set in your agreement based on the job, reserves your place on the schedule. Your agreement states the exact deposit and payment schedule.
- Invoices are due by the due date shown on them. You can pay online by card, bank transfer (ACH), Apple Pay or Google Pay through Stripe’s secure checkout, or by check payable to New West Co LLC.
- Online payments are processed by Stripe, Inc. and are also subject to Stripe’s terms. We never see or store your full card or bank account number.
- We do not add a surcharge for paying by card.
- Past due balances may accrue interest as stated in your agreement or, if none is stated, as allowed by Colorado law. A returned or declined payment may carry a fee as allowed by Colorado law.
- If you believe a charge is wrong, please contact us first. We will look into it quickly and fix any mistake.
Your right to cancel
If you sign a contract at your home, or at a place that is not our place of business, the Federal Trade Commission’s Cooling Off Rule generally gives you until midnight of the third business day after signing to cancel. When that rule applies, your contract includes the required cancellation notice and form. If you cancel within that time, we refund payments within 10 business days.
After that period, cancellation is governed by your signed agreement, which may allow us to keep payment for work performed and for special order materials that cannot be returned.
Warranty
We stand behind our work. The workmanship warranty for your project is stated in your signed agreement. Manufacturer warranties on products and materials are passed on to you, and we will help you use them.
Warranties do not cover damage from misuse, lack of normal maintenance, alterations by others, settling or movement outside our control, or acts of nature.
Construction defect claims in Colorado
If something is wrong with our work, please tell us right away. We want the chance to make it right.
Colorado’s Construction Defect Action Reform Act (C.R.S. 13-20-801 et seq.) sets a process for construction defect claims. Before filing a lawsuit about a residential construction defect, a homeowner must send the contractor a written notice of claim at least 75 days before filing. The notice gives the contractor the right to inspect the property and offer to repair the problem or pay a settlement.
Nothing in these Terms limits or waives any right or remedy you have under that Act or other Colorado law, which Colorado does not allow for residential property in any case.
Liens and lien waivers
Under Colorado’s mechanics’ lien law (C.R.S. 38-22-101 et seq.), contractors, subcontractors, workers and suppliers who are not paid for work or materials on a property may have the right to file a lien against that property. Colorado law also requires that money paid to a contractor for a project be held in trust to pay the subcontractors and suppliers on that project (C.R.S. 38-22-127), and we follow that rule.
When you pay us, we will provide lien waivers on request for the amounts paid.

Website disclaimer and limits
The website and its content are provided as is. We work to keep information accurate, but we do not promise that the site will always be available, current or free of errors. Links to other websites are provided for convenience and we are not responsible for their content.
To the fullest extent allowed by law, New West Co LLC is not liable for indirect or consequential damages arising from your use of the website alone. Governing law and disputes

Any lawsuit about these Terms or the website will be brought in the state courts located in Larimer County, Colorado. Nothing here prevents either of us from using small claims court.
Changes to these terms
We may update these Terms from time to time. The date at the top shows when they last changed. Changes do not affect agreements you have already signed.
If any part of these Terms is found unenforceable, the rest remains in effect.
